AKABANE BUSSAN TRADING CO., LTD. EASY ORDERING PROCEDURE AND BASIC BUYER-SELLER AGREEMENT

  1. MEMBER’S REGISTRATION:
    You need to apply and become a member of Akabane Bussan Home Delivery System in order to use the service.
    We accept registrations through telephone & fax. Membership registration is free of charge. Members will be able to purchase our products and receive various information services.
    Membership status will automatically remove after six months if a member does not purchase any item during the period.
  2. HOW TO USE THE SYSTEM:
    You will be able to start using the system after completing registration. Orders could be made through Telephone & Fax.

    *Please contact us for the Buss. Operations on Year End and Resumes of Buss. Operations after Holiday Season.
    Ordering after Business Hours : Orders could be made by fax. In this case, orders will be processed accordingly after confirmation by the AKABANE BUSSAN’s staff to the customer.
  3. PRICE OF MERCHANDISE:
    Price of merchandises are listed on our Merchandise Catalogue. The prices indicated are excluded of 5% tax, consumer tax(5%),delivery fee & collect delivery charge.
    These charges are to be paid separately by the member accordingly.
  4. PAYMENT OF MERHANDISES & MERCHANDISE DELIVERY:
    A. BANK REMITTANCE & POST REMITTANCE ( YUUBIN FURIKAE):

    1. 1) Remittance of the total sum of purchased goods including the tax, delivery fees, etc., can remit to the following accounts upon order:

    2. 2) Ordered Merchandises will be dispatched upon confirmation of remittance till 16:00 ; remittance confirmed after 16:00 will be dispatched the next day.
    3. 3) Purchased Merchandises will be delivered to your doorsteps within 5 days or earlier. Delivery companies consist of Yamato Takkyubin, Sagawa Kyuubin, Seino Unyu.
      We will be using these companies for deliveries. (Except for the customer’s special request of what courier service they choose to use.) Ordered merchandises mainly consist of Futsuubin (Dry), Reizou (Chilled) , or Reitou (Frozen). If the ordered merchandises consist of dry and frozen goods, we will separate the merchandises accordingly. (There are some cases that some merchandises can’t be combined (Konsai) to send as one package). Some deliveries may not arrive within designated time due to accidents, road traffic, etc. We will not assume any responsibility for accidents or losses due to these reasons which may inflict with the members.

    4. 4) Delivery Charge is as follows ( max. weight limit of 10kg. For further details of delivery charges please inquire us upon placing order.).

    B. COLLECT SERVICE ( Payment of the total sum upon delivery. There are areas and amount of purchases which may not be processed/accepted.)

    1. 1) For payment in cash : Upon arrival, please pay the total amount of the merchandise, 5% consumption tax , and delivery charge directly to the delivery staff.
    2. 2) Maximum worth of purchase order is JPY 200,000 if cash on delivery.
      • (A) Orders made till 16:00 will be dispatched the same day, orders made after 16:00 will be dispatched the next day.
      • (B) Arrival of purchased merchandises may arrive within 5 days upon order or earlier. Regulations regarding the delivery companies are the same as A
      • (C) Upon arrival of goods, please pay directly to the delivery staff the total sum of purchased goods which consist of merchandises, Tax and delivery charge Collect Service Fee will be paid by the customer). Delivery charge is the same as A
      • (D) Members could also come to visit Akabane Bussan to purchase and pay over the counter (walk-in customer). In case of visit, please make sure your orders & appointment is confirmed prior to your visit. Appointment of visit can be done through telephone or fax. (Business Hrs. 10:00 – 18:00)
  5. REQUEST FOR RETURN OF GOODS/REIMBURSEMENT DUE TO MEMBER’S OWN FAULT(WRONG ORDERS MADE ITSELF):
    1. 1) Refund & reimbursement (excluding ice cream products, opened product and special order )We will not be accepting unless the members have been contacted & informed us on the day of arrival where the merchandise arrived. Any demands for refunds & reimbursement requests by the customer after receiving of the goods that are not informed to Akabane Bussan will not be accepted. Fees and other charges that may occur necessarily for the reimbursement will be paid by the member/s. Please contact us for further details in terms of refund and reimbursement.
    2. 2) If the member/s cancel or refuse to receive the delivery of goods after the order has been processed , the member will be obliged to pay for all the delivery fees (back & forth) plus the handling charges and other necessary fees involved in the process.
  6. REFUND& REIMBURSEMENT DUE TO MISDELIVERY,QUALITY DETERIORATION OF MERCHANDISE,ETC.,OR FAULT DONE BY AKABANE BUSSAN:
    Refund & reimbursement due to misdelivery of goods, quality deterioration of merchandises, and other negligence done by Akabane Bussan’s part will be accepted within 7 days upon arrival of merchandises. In this case, the cost of delivery for the reimbursement, and other expenses will be charged to Akabane Bussan’s own expense. We will not accept any refunds or reimbursement after 7 days upon arrival of merchandises. Please contact us for further details.
  7. DAMAGED MERCHANDISES DURING DELIVERY:
    There are some occasions that some merchandises are damaged during delivery, Please always check your merchandises upon arrival. If you find any damaged merchandises, please inform the delivery staff directly. Upon confirmation, the delivery staff will sign as proof confirming the fact of damages done to the merchandises. Please contact us after this procedure. If the delivery staff is not present at the time you discovered the damaged merchandise, please call the delivery company immediately to get their confirmation and signature. Please be careful not to forget their confirmation and signature because you may not be able to get replacement/reimbursement of the damaged goods.
  8. REASONS FOR CANCELLATION OF RECORD, REJECTION AND DECLINE CUSTOMER’S ORDER BY AKABANE BUSSAN:
    1. 1) Providing wrong/false information being registrant such as Name, Address, Telephone No., Allowing other buyers/clients to use his/her registered personal record at Akabane Bussan to purchase items, will result to cancellation of registration. Akabane Bussan has the right to ban the client for violating the policy.
    2. 2) Creating Problem/annoyance to the company. (a. Cancellation of purchased orders after confirmation without valid reason. b. Non-payment of delivered goods.)
    3. 3) Akabane Bussan reserves the right to REJECT or APPROVE any application for registration, purchase orders by its own prerogative.
  9. REGARDING OUR CATALOGUE:
    Some merchandises on the catalogue (photo) may occasionally differ from the original merchandises. Some merchandises may be out of stocks or not for sale occasionally.
    Please inquire us before making any orders.
  10. Alcoholic drinks policy
    Alcoholic drinks is prohibited to minors.
    When place an order, age verification is strictly required.
    For via fax order, please do not skip to write your AGE in the order sheet form.

  11. MUTUALLY AGREED COURT OF JUSTICE:
    Disagreement or any violation between the two parties based on this TERMS OF AGREEMENT will be processed and brought forth to the LOCAL TOKYO COURT OF JUSTICE to be judged by the LOCAL TOKYO COURT OF JUSTICE. INDICATION OF REGISTRATION REQUIRED UNDER THE SPECIAL MERCHANDISE & COMMERCE LAW.
